Terms of Service
These Terms of Service ("Terms") are a contract between you and TechnicallyFit Dynamics Inc. governing your use of our website, web application, and mobile application (the "Services"). By creating an account or using the Services, you agree to these Terms.
Accounts and eligibility
You must meet the minimum age and are responsible for your account and credentials. Authentication is provided through Clerk.
Subscriptions and billing
Paid plans are billed through Stripe on the cadence shown at checkout. Free trials, if offered, convert to paid unless canceled before the trial ends. Fees are non-refundable except where required by law or expressly stated.
Health and fitness disclaimer
The Services provide general fitness and wellness information and tools. They are not a medical device and do not provide medical advice, diagnosis, or treatment. Readiness, recovery, injury-risk, and pain-related features are for general wellness and informational purposes only. Consult a qualified healthcare professional before beginning any exercise program, and stop and seek care if you experience pain, injury, or symptoms. You assume the risks of physical activity.
Acceptable use
You agree not to misuse or disrupt the Services, reverse engineer them, infringe others' rights, upload unlawful content, or use the Services for medical diagnosis or treatment.
Content, IP, and third parties
You retain ownership of content you submit and grant us a limited license to host and display it to operate the Services. The Services and underlying engine are owned by TechnicallyFit. The Services integrate third parties (e.g., Stripe, wearables via Terra) whose terms may apply.
Disclaimers and liability
The Services are provided "as is" without warranties to the maximum extent permitted by law, and our liability is limited to the maximum extent permitted by law.
Termination, governing law, and changes
We may suspend or terminate access for breach or to comply with law. You may stop using the Services at any time. Governing law, venue, and dispute resolution are governed by applicable law. We may update these Terms and will post the updated version with a new "Last updated" date.
Health, wearable, pain, and readiness data — how this is governed
This Terms document is the contract between you and TechnicallyFit. Because these Terms may be consumed through an integration where linked Notion pages are not available, this section summarizes the key rules for health, wearable, pain, and readiness data. | (c) With whom it is shared (subprocessors named) | We share personal information and consumer health data only as needed with service providers/subprocessors under contract, with your coach or organization where you have opted into that relationship, with payment processors for billing, with authorities when legally required, and in a business transaction. Subprocessors include Clerk, Stripe, Stream (GetStream), Resend, PostHog, Sentry, Terra, Expo / EAS, DigitalOcean, Cloudflare Stream, Doppler, Anthropic / OpenRouter, Convex while legacy data is decommissioned, and features.vote for optional beta-interest capture. Supabase is not in use. PostHog and Sentry are configured to exclude consumer health data from event payloads; Cloudflare Stream and Doppler are not intended to receive user health data. |
| (d) Retention duration / class | We retain personal information and consumer health data only as long as needed to provide the Services, operate and secure the product, meet legal obligations, resolve disputes, enforce agreements, and maintain records required by law. Consumer health data is retained only as long as needed for the features you use or as required by law. Deleted data may remain for a limited period in encrypted backups that expire on a rolling schedule, and limited billing, tax, fraud-prevention, security, or legal records may be retained where required or permitted by law. | (e) Deletion / withdrawal mechanism | You may request access, export, correction, deletion, withdrawal of consent to consumer health data collection or sharing, and appeal of a denial where applicable. If you have an account, sign in at app.technicallyfit.com, open Settings, and use the data export or account deletion actions where available. You may also contact the privacy/support channel listed on the website at /legal/data-deletion; general product support is available at [email protected]. We may verify your identity before fulfilling a request. When deletion is requested, we delete data we hold directly and direct subprocessors to delete data they hold on our behalf, subject to legal retention, backup, security, fraud-prevention, and de-identified/aggregated-data exceptions. |
